1. Acceptance
By downloading, accessing, or using SihatOS (the “App” or “Service”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the App.
2. Who may use SihatOS
SihatOS is a business operations tool for clinics and related service businesses, including point of sale (POS), members, appointments, clinical notes, receipts, staff tools, commissions, and reports. You represent that you have authority to bind the clinic or business account that uses the App.
3. Accounts and access
- You are responsible for account credentials, staff PINs, manager PINs, and device access.
- Keep login details confidential and notify us promptly of any unauthorized use.
- We may suspend access for security reasons, abuse, non-payment, or violation of these Terms.
4. License
We grant you a limited, non-exclusive, non-transferable, revocable license to use SihatOS for your internal business operations, subject to these Terms and any subscription or demo agreement.
5. Your data and responsibilities
You (the clinic or business) remain the controller of patient/customer and business data entered into SihatOS. You must:
- Obtain any required consents for collecting and processing personal or health-related data
- Use the App lawfully, including under Malaysia’s Personal Data Protection Act 2010 (PDPA) and applicable clinic rules
- Ensure staff only access data they are authorized to see
- Verify sales, tax (including SST), commissions, clinical records, medical certificates (MC), and exports before relying on them
We provide software tools. We do not provide medical, legal, or tax advice. Clinical decisions and tax treatment remain your responsibility.
6. Acceptable use
You must not:
- Reverse engineer, copy, or resell the App except as allowed by law
- Bypass security or PIN controls, or access another tenant’s data
- Upload malware or unlawful content
- Use the App to harm patients, staff, or third parties
7. Subscriptions, demos, and fees
Demo or paid access may be offered under separate commercial terms. Fees (if any), renewal, and cancellation follow the agreement or invoice provided to you. Failure to pay may result in suspension.
8. Intellectual property
SihatOS, branding, user interface, and related software are owned by Polaris Aura Sdn Bhd or its licensors. No intellectual property rights are transferred except the limited license above.
9. Third-party services
The App may integrate with third parties (for example payments, messaging, cloud hosting, or app stores). Their terms apply to those services.
10. Availability and changes
We aim for reliable service but do not guarantee uninterrupted or error-free operation. We may update features and may modify these Terms with notice via the App, website, or email. Continued use after changes means acceptance.
11. Disclaimer
The Service is provided “as is” to the extent permitted by law. We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement, except where mandatory law requires otherwise.
12. Limitation of liability
To the maximum extent permitted by law, Polaris Aura Sdn Bhd is not liable for indirect, incidental, special, consequential, or lost-profit damages, or for data loss arising from your use of the App. Our total liability for any claim relating to the Service is limited to the fees you paid us for SihatOS in the 12 months before the claim (or RM 0 if using a free demo only), except where liability cannot be limited by law.
13. Indemnity
You agree to indemnify us against claims arising from your misuse of the App, your handling of patient or customer data, or your breach of these Terms or applicable law.
14. Termination
You may stop using the App at any time. We may terminate or suspend access for breach or operational reasons. Provisions that should survive (including intellectual property, liability, indemnity, and governing law) will survive termination.
15. Governing law
These Terms are governed by the laws of Malaysia. Disputes shall be subject to the courts of Malaysia, unless mandatory rules provide otherwise.
